The legal definition is clear: the insurer is obliged to provide "the services required for safeguarding the legal interests of the policyholder" (source: Section 125 VVG, gesetze-im-internet.de, translated). In concrete terms: lawyers' fees, court costs, experts, witness fees, the other side's costs if you lose – depending on the module for private, employment, traffic and housing law. If the insurer declines due to lack of prospects of success, the law protects you: for disputes, "an expert opinion procedure or another procedure with comparable guarantees of impartiality" must be provided (source: Section 128 VVG, gesetze-im-internet.de, translated) – your lawyer's casting decision (Stichentscheid).
In Europe and the Mediterranean rim states, good policies apply without time limit and with full sums insured – important for cross-border commuters, second homes and long stays.
Outside Europe, many policies limit the duration of stay (e.g. coverage only for stays of up to 1–5 years) and the sum insured (e.g. 100,000–500,000 €). For expats in the USA or Asia, high worldwide sums are crucial – US litigation costs quickly blow small limits.
