Accident Insurance: Statutory Protection and Private Coverage Explained

What is accident insurance – and is the statutory protection enough? In Germany, two systems exist side by side: statutory accident insurance as part of the social security system, and private accident insurance as a voluntary supplement. What Is Statutory Accident Insurance?

Statutory accident insurance is mandatory insurance for employees, trainees, school pupils, students and other groups. Its legal mission is clearly stated in Section 1 SGB VII: it is meant to help "prevent work accidents and occupational diseases as well as work-related health hazards" and to restore health and capacity after an insured event (source: gesetze-im-internet.de, translated). The special feature: the employer alone pays the contributions – for you as an employee, the protection is free of charge and applies automatically from your first day at work, without registration.

What Counts as a Work Accident – and What Doesn't?

You are covered at work itself and on the direct way there and back (commuting accident). The law defines: "Work accidents are accidents suffered by insured persons as a result of an activity establishing insurance coverage" (source: Section 8 SGB VII, gesetze-im-internet.de, translated). Recognised occupational diseases are also included. Private accidents, however, are not covered: the fall during sports, the weekend bike accident, the slip in the bathroom – and that is exactly where most accidents happen.

Statutory vs. Private: The Coverage Gap

Statutory accident insurance only covers work, the commute, school and university. Leisure, household and sports – statistically the majority of all accidents – remain unprotected. Private accident insurance closes this gap: it pays worldwide and around the clock, above all a lump sum in the event of permanent disability, which you can use to finance conversions, aids or income gaps. Whether it makes sense for you depends on your situation – the self-employed without statutory protection, families with children and active athletes benefit in particular.

What is accident insurance in simple terms?

Accident insurance covers the financial consequences of accidents. The statutory version automatically protects you at work, at school and on the way there; the private version voluntarily protects you worldwide and around the clock, especially in the event of permanent disability.

Who is covered by statutory accident insurance?

Employees, trainees, school pupils, students, kindergarten children, many volunteers and caregivers – by law and without paying contributions. The self-employed are usually not automatically covered but can insure themselves voluntarily.

Do I have to pay anything for statutory accident insurance?

No. The contributions are borne solely by the employer or, for pupils and students, by the public purse.

Is private accident insurance worth it?

It makes sense if leisure accidents pose a financial risk for you – for example as a self-employed person, athlete, or if occupational disability insurance is not available to you. We assess your situation individually.
